General Terms of Use for the free use of the Job board at the HTW Dresden

The Career Service of the HTW Dresden University of Applied Sciences operates this website to provide information about job offers, in order to offer students and companies a chance to get in touch with each other.

After successfully confirming their registration, students can create a search profile to subscribe to newly placed job vacancies and useful information about their professional career. In addition, students can create their applicant profile. This profile is proposed to premium members whose job offers have the additional matching criteria and match the applicant’s profile.

After the successful confirmation of registration, companies will be given the opportunity to publish vacancies, points of contact and their respective details.

1 General

The registration and the use of the search and provider profiles on the Job Board of the HTW Dresden are based exclusively on these General Terms and Conditions (GTC).

2. Teilnahme / Nutzung des Systems

2.1 Um die Funktionen der Jobbörse vollständig nutzen zu können, ist eine Registrierung notwendig. Die Registrierung und die Nutzung des Systems sind freiwillig und kostenlos. Die HTW Dresden behält sich jedoch vor, den Service jederzeit einzustellen bzw. nach vorheriger Information der Nutzer zukünftig ganz oder teilweise nur noch kostenpflichtig anzubieten.
Für die unternehmensseitige Nutzung bestehen darüber hinaus zusätzliche kostenpflichtige Service. Die diesbezüglichen Vertragsmodalitäten sowie die Angebote und Kosten sind dem Leistungsverzeichnis sowie den Allgemeinen Nutzungsbedingungen für die kostenpflichtige Nutzung der Jobbörse der HTW Dresden (Premiummitgliedschaft) zu entnehmen.
2.2 Eine Registrierung und Nutzung der Dienste ist sowohl unter Eingabe des Klarnamens als auch unter Pseudonym möglich. Die korrekte Eingabe der bei der Registrierung einzugebenden Daten dienen hierbei der besseren Kommunikation mit den Nutzern in Verbindung mit dem Zweck der Jobbörse. Die Nutzer legen ein eigenes Profil mit (soweit sie diese angeben) personenbezogenen Daten an. Die HTW Dresden bzw. deren autorisierte Mitarbeiter können diese Daten nutzen, um mit dem Nutzer Kontakt zum Bezug der abonnierten Informationen aufzunehmen. Die Nutzung ist hierbei auf den Eigenbedarf ausgelegt und darf nicht an Dritte weitergegeben werden.
2.3 Ein Anspruch auf Registrierung besteht nicht. Die HTW Dresden behält sich vor, einzelne Personen von der Nutzung auszuschließen sowie in begründeten Fällen nach Rücksprache mit dem Nutzer sämtliche externen Eingaben zu löschen, rückgängig zu machen oder zu korrigieren. Die HTW Dresden entscheidet über und vergibt die Eingabeberechtigung und kann diese jederzeit wieder entziehen.
2.4 Vor der Veröffentlichung von Stellenangeboten werden diese punktuell durch den Career Service auf Vereinbarkeit mit den Nutzungsbedingungen (siehe Ziffer 5) geprüft. Die Veröffentlichung erfolgt jeweils für vier Wochen. Eine erneute Veröffentlichung ist möglich.

3. Terminate membership

The user is given the chance to irrevocably delete his / her account and thus all personal data at any time. Use the form to maintain your profile.

4. Data protection

The HTW Dresden takes the protection of your personal data very seriously. We have taken technical and organisational precautions to protect your personal  information and comply with data protection regulations. Insofar as you disclose personal data, the HTW Dresden shall store this on an internal university server to which only a few authorised persons have access. The data will not be published or passed on to third parties. The profile information data is only accessible to the Administrator and is processed  automatically for the purpose of disseminating subscribed information.

5. Industrial property rights, exclusion of offers

5.1    The user shall undertake to respect the copyright and industrial property rights of third parties. In particular, the user shall undertake to only include content in the system  to which he holds the copyright or at least a simple right of use  for his own purposes, and shall inform the HTW Dresden immediately if he subsequently  learns that, due to the content in question , certain intellectual property rights of third parties have been infringed upon.

5.2    All entries must comply with the statutory provisions. In particular, offers of a discriminatory, politically extremist, pornographic, youth-endangering or otherwise punishable or irregular nature  shall be excluded. Entries that serve non-material purposes, in particular those that wholly or partially advertise products or services (spam), shall not be allowed.

5.3   Offer data and company profiles shall be removed if misleading or false  information is entered, for example, concerning the provider or the content, and  if the content can damage the reputation  of the HTW Dresden publically. The HTW Dresden reserves the right to withdraw the entry authorisation in this case.

6. Liability, availability, exclusion of damages

6.1 The University does not guarantee the content, correctness, completeness or timeliness of the data stored by the users. The same applies to successful placements, a rate of success and / or in relation to an application goal involving the use of the job board. </ B> 6.2 The HTW Dresden endeavours, to the best of its knowledge and beliefs and according to its capabilities, to ensure that the job board is error-free, and that it stays online without interruption. In the event of technical and substantive errors as well as the temporary failure to grant the possibility of access, no claims for damages may be asserted unless they are as a result of, at the very least, gross negligence on the part of the HTW Dresden, its legal representative or a vicarious agent. </ B> 6.3 The HTW Dresden is liable moreover, exclusively in accordance with statutory provisions. </ br> 1. for damages resulting from wilful or negligent injury to life, body or health, </ br> 2. for other damages in the event of intent, gross negligence and </ br> 3. in the event of a violation of the Product Liability Act. </ br> Liability for slight negligence is expressly excluded to the extent permitted by law. Liability for gross negligence is limited to the compensation of immediate damages. Liability for consequential damage, in particular financial loss, is hereby excluded. </ B> 6.4 As part of an internal professional relationship, the user shall hereby indemnify the HTW Dresden from liability vis a vis third parties, provided that any claim asserted by the third party is exclusively the fault of the user. < / b>

7. Cancellation policy

Right of cancellation</ b> You may cancel your contract within 14 days in writing (e.g. letter, fax, email) without providing a reason. The period shall begin after receipt of this instruction in writing, but not before the conclusion of the contract and not before the fulfilment of our information obligations under Article 246 § 2 in conjunction with § 1 paragraph 1 and 2 of the EGBGB and our obligations under § 312g paragraph 1 sentence 1 of the BGB in conjunction with Article 246 § 3 of the EGBGB. The timely dispatch of a notice of cancellation shall be deemed sufficient for compliance with the cancellation period. The cancellation is to be sent to:

Fax: 0351 462 43343 </ b> Consequences of cancellation </ b> In the case of an effective cancellation, the mutually received benefits shall be returned pro rata and any benefits (such as interest) incurred shall be surrendered. If you cannot return the received benefit or parts thereof (e.g. benefits of use) or only in a deteriorated condition, you will be required to pay us compensation. This may mean that you still have to fulfil the contractual payment obligations for the period up until the cancellation. Obligations to reimburse payments must be fulfilled within 30 days. The period shall begin for you with the dispatch of your cancellation, and for us with its receipt. </ B> Special Notice </ b> Your right of cancellation shall expire prematurely, if the contract has been completely fulfilled by both parties as per your request and before you have exercised your right of cancellation. </ b> End of the cancellation policy </ b>

8 Final Provisions

8.1   Verbal ancillary agreements do not exist.

8.2   Changes and additions to this agreement must be made in writing. This also applies to the waiver of the written form requirement or changes to the written form requirement.

8.3   Rights and obligations under this agreement may only be transferred to third parties or relinquished to third parties with the prior written consent of the other party.

8.4   Should individual provisions of this agreement be or become wholly or partially invalid, this shall not affect the validity of the remainder of the agreement. In this case, the partners undertake to replace the ineffective or unenforceable provision by an effective or enforceable provision that comes as close as possible to the purpose of the economic intent. The same applies in the case of a contractual loophole.

8.5   German law shall apply to the contract. As far as a jurisdiction agreement is permitted, Dresden is the place of jurisdiction for all disputes arising from or in connection with the contract.
