General Terms of Use for the free use of the Job board at the HTW Dresden

The Career Service of the HTW Dresden University of Applied Sciences operates this website to provide information about job offers, in order to offer students and companies a chance to get in touch with each other.

 

Applicants/job seekers can establish a search profile after successful confirmation of registration in order to subscribe to newly posted job vacancies and useful information on career entry. In addition, applicants/job seekers can establish their own applicant profile. This profile is suggested to premium members whose job vacancies have additional matching criteria and match the applicant profile. The legal basis for the data processing is the voluntary consent of the job-seeking user. Text passages relevant in this respect are underlined.

After the successful confirmation of registration, companies will be given the opportunity to publish vacancies, points of contact and their respective details.

1 General

The registration and the use of the search and provider profiles on the Job Board of the HTW Dresden are based exclusively on these General Terms and Conditions (GTC).

[Translate to Englisch:] 2.1 Registration is required for the full use of the functions of the job market. Registration and use of the system are optional and free of charge. The HTW Dresden reserves the right to cancel the service at any time and/or to offer it in the future entirely or partially only on a pay-for-use basis, having previously informed the user.
2.2 Registration and use of the service is possible by providing either a real name or a pseudonym. The provision of accurate information when registering serves to ensure better communication with the users in connection with the purpose of the job market. The user establishes his/her own profile with personal data (to the extent that this is provided). The HTW Dresden or its authorised employee can use this data to contact the user in regard to the information to which the user has subscribed. This use is for our own purposes only and may not be passed on to third parties.
2.3 There is no claim to registration. The HTW Dresden reserves the right to exclude individual persons from use as well as to delete, reverse or correct all information provided externally after consultation with the user in justified cases. HTW Dresden decides on and grants input authorisation and can revoke this at any time.
2.4 Before publishing, job offers will get inspected and activated by the Career Service in order to proof the compatibility with GTC. The job offer will be published for a period of four weeks. It is possible to publish job offers again.

3. Terminate membership

The user has the option to irrevocably delete his/her account and thus all personal data at any time. For this purpose, please use the form for the maintenance of your profile.

4. Data protection

In accordance with Art. 13 of the EU General Data Protection Regulation, you are notified that: Data processing in carried out by the HTW Dresden, Friedrich-List-Platz 1, 01069 Dresden. The data protection officer can be contacted at datenschutz@htw-dresden.de. All natural persons whose data is processed have the right to information from the HTW Dresden on the personal data relating to their person as well as the right to correction or deletion, or to the restriction of processing, or the right to object to the processing, as well as the right to data portability and a right to lodge a complaint with the supervisory authority. Transfer to potential employers (for definition, please see above) is carried out following automatic comparison of the employer’s requirements with the applicant profile.
Consent of the job-seeking user:
The data provided by me will be used for the purposes represented above on the basis of the consent hereby provided, which can be revoked at any time. The data shall be deleted as soon as consent is revoked and there are no other legal grounds for the further processing. In creating an applicant profile, the data will be transferred to premium job market clients = potential employers (for a list of companies, please see www.htw-dresden.de/jobboerse/unternehmenskontakte. Employers outside the European Economic Zone and in countries without a reasonable level of data protection can also participate in the job market and thus access my data. I expressly provide my consent also in this respect. I am aware that my rights as the data subject in such cases may be effectively asserted neither by me nor by the HTW. I can revoke this consent at any time, e.g. through the deletion of my account in accordance with No. 3.

5. Industrial property rights, exclusion of offers

5.1 The user undertakes to comply with the copyright and industrial property rights of third parties. The user undertakes in particular to add only such content to the system to which her/she holds the copyright or at least a simple right of use for his/her own purposes, and to inform the HTW Dresden immediately he/she becomes aware at a later stage that the content provided violates the industrial property rights of third parties.
5.2 All inputs have to comply with legal requirements. Offers which contain discriminating, politically extremist, pornographic, liable to corrupt the youth or other punishable by law or irregular contents will be excluded. In addition, inputs which serve irrelevant purposes - especially those which fully or partly advertise a certain product or service (spam) - are inadmissible.
5.3 Data of offers and company profiles will be deleted if they contain misleading or false information (for example about offerer or content) or if the content may harm the HTW Dresden’s reputation. The HTW Dresden reserves the right to withdraw entry authorisation in this case.

6. Liability, availability, exclusion of damages

6.1 The University does not guarantee the content, correctness, completeness or timeliness of the data stored by the users. The same applies to successful placements, a rate of success and / or in relation to an application goal involving the use of the job board.
6.2 The HTW Dresden strives in all consciences and by all available means to keep the job fair online accurately and without interruption. Damages cannot be claimed due to technical or contentual mistakes as well as non-provision or failure of access at times as long as these are not on at least gross negligence of the HTW Dresden, its legal representatives or a vicarious agent.
6.3 Apart from that, the HTW Dresden is liable unrestrictedly according to legal requirements:Apart from that, the HTW Dresden is liable unrestrictedly according to legal requirements:
1. for damages which arise of wilful or negligence injury of life, body or health
2. for other damages due to wilfulness, gross negligence as well as
3. contravention of the product liability law.
Liability due to slight negligence is expressly excluded to the extent permitted by law. Liability due to gross negligence is limited to the replacement of direct damage. Liability for consequential damages - especially financial losses - is excluded.
6.4 In the internal relationship, the user releases HTW Dresden for liability vis-à-vis third parties if the claims made by the third party are based on the sole fault of the user

7. Cancellation policy

Right of cancellation</ b> You may cancel your contract within 14 days in writing (e.g. letter, fax, email) without providing a reason. The period shall begin after receipt of this instruction in writing, but not before the conclusion of the contract and not before the fulfilment of our information obligations under Article 246 § 2 in conjunction with § 1 paragraph 1 and 2 of the EGBGB and our obligations under § 312g paragraph 1 sentence 1 of the BGB in conjunction with Article 246 § 3 of the EGBGB. The timely dispatch of a notice of cancellation shall be deemed sufficient for compliance with the cancellation period. The cancellation is to be sent to:

Fax: 0351 462 43343 </ b> Consequences of cancellation </ b> In the case of an effective cancellation, the mutually received benefits shall be returned pro rata and any benefits (such as interest) incurred shall be surrendered. If you cannot return the received benefit or parts thereof (e.g. benefits of use) or only in a deteriorated condition, you will be required to pay us compensation. This may mean that you still have to fulfil the contractual payment obligations for the period up until the cancellation. Obligations to reimburse payments must be fulfilled within 30 days. The period shall begin for you with the dispatch of your cancellation, and for us with its receipt. </ B> Special Notice </ b> Your right of cancellation shall expire prematurely, if the contract has been completely fulfilled by both parties as per your request and before you have exercised your right of cancellation. </ b> End of the cancellation policy </ b>

8 Final Provisions

8.1   Verbal ancillary agreements do not exist.

8.2   Changes and additions to this agreement must be made in writing. This also applies to the waiver of the written form requirement or changes to the written form requirement.

8.3   Rights and obligations under this agreement may only be transferred to third parties or relinquished to third parties with the prior written consent of the other party.

8.4   Should individual provisions of this agreement be or become wholly or partially invalid, this shall not affect the validity of the remainder of the agreement. In this case, the partners undertake to replace the ineffective or unenforceable provision by an effective or enforceable provision that comes as close as possible to the purpose of the economic intent. The same applies in the case of a contractual loophole.

8.5   German law shall apply to the contract. As far as a jurisdiction agreement is permitted, Dresden is the place of jurisdiction for all disputes arising from or in connection with the contract.
